1. Acceptance of Terms

By booking or participating in any class or service provided by On Cue Group Pty Ltd (ACN 689 576 761) (“On Cue”, “we”, “us”, “our”), you agree to be bound by these Terms and Conditions.

If you do not agree to these Terms and Conditions, you must not participate in any On Cue classes or services.

On Cue reserves the right to amend, update, or replace these Terms and Conditions at any time. The most current version will be available on the On Cue website, and your continued participation constitutes acceptance of any updated terms.

2. Medical Disclaimer

Before commencing any class, you should consult your doctor or a qualified healthcare practitioner to ensure you are aware of your physical capabilities and limitations.

If you experience pain, dizziness, or discomfort during any class, you must stop immediately and notify the instructor. Seek medical advice if you experience any unexpected or ongoing changes to your physical condition.

You must inform your instructor of any pre-existing injuries, medical conditions, or pregnancies that may affect your ability to safely participate in classes.

Participation in On Cue classes and use of studio equipment is undertaken at your own risk. To the extent permitted by law, On Cue, its instructors, employees, and contractors are not liable for any personal injury, loss, or damage arising from your participation.

We reserve the right to refuse participation where we believe attendance may pose a risk to your health or the safety of others.

3. Pricing, Accounts & Bookings

Current pricing, class timetables, and availability are displayed on the On Cue website and via the Momence app. Prices are subject to change at any time.

You must create an account to purchase memberships, class packs, or book classes.

Class sizes are limited. You must book your place before attending a class. Bookings can be made online via the On Cue website or the Momence app. On Cue can assist you via phone or email if required. 

4. Cancellation Policy

If you are unable to attend a booked class, you must cancel at least 4 hours prior to the class start time.

Late cancellations or no-shows will result in:

  • Forfeiture of the class, and

  • A $15 late cancellation/no-show fee

Repeated late cancellations or no-shows may result in temporary booking restrictions.

Cancellations can be made online via your account or by contacting the studio.

5. Minimum Age

  • The minimum age to attend classes is 15 years

  • Participants in promotions, giveaways, or competitions must be 18 years or older

6. Waitlists

If a class is full, you may join the waitlist. If a spot becomes available, you will be notified via email and SMS and will have 20 minutes to confirm your booking.

If you are no longer able to attend, you must remove yourself from the waitlist via the website or app.

7. Class Packs

  • All classes must be pre-paid before attending.

  • Class packs are non-transferable and may not be shared, sold, or gifted

  • Class packs have a strict expiry date

  • Unused classes expire without refund once the expiry date is reached

All class pack sales are final. No refunds, transfers, or credits are provided for illness, injury, change of mind, user error, or unsuitability.

Extensions or suspensions for medical reasons may be considered on a case-by-case basis with written documentation from a registered healthcare practitioner.

Requests for extensions due to travel or other exceptional circumstances may be considered at On Cue’s discretion. Supporting evidence may be requested. Any approved extension will be limited in duration and must be requested prior to the expiry of the membership or class pack.

On Cue reserves the right to refuse any request where sufficient notice or documentation is not provided.

The current prices and expiry time frames for each type of class pack can be found on the On Cue website, this may be amended from time to time.

8. Memberships

Memberships:

  • Are non-transferable

  • Are subject to expiry and usage limits

  • Do not allow refunds for unused classes after expiry

 You may cancel a membership within 7 days of purchase by providing written notice. Any refund will be less the value of services already used and any applicable administration fees, in accordance with Australian Consumer Law.

Pauses or suspensions for medical reasons may be considered on a case-by-case basis with written documentation from a registered healthcare practitioner.

9. Referral Credit

Referral Credit may be offered at On Cue’s discretion to existing clients of On Cue and may be used towards purchasing class packs or memberships. The Referral Credit

  • Is not redeemable for cash

  • Is not transferable.

10. Gift Vouchers

Gift Vouchers:

  • May be purchased or issued as promotions

  • Are valid for 12 months from issue

  • Are not redeemable for cash

  • Are non-refundable and non-replaceable if lost or stolen

  • Unused balances after expiry are forfeited. 

On Cue bears no responsibility for loss or theft of Gift vouchers.

11. Class Schedules & Studio Operations

Class schedules, instructors, and opening hours may change without notice.

On Cue is not liable to provide refunds or compensation for cancelled or rescheduled classes.

We reserve our right to change our opening hours at any On Cue locations at any time without notice to you. You will be notified of any permanent changes to our trading hours.

12. Conditions of Entry

On Cue reserves the right to refuse entry or remove any person behaving in a manner that is unsafe, disruptive, offensive, or inappropriate. You are required to treat all persons and property at On Cue locations with all due care and respect.

Clients are encouraged to arrive 5–10 minutes early. Once the class has commenced, trainers have the right to refuse your entry and your position in the class may be given to another client. 

Appropriate activewear is required. Socks are mandatory for hygiene purposes. Grip socks are available for purchase.

Smoking is prohibited inside and immediately outside studio entrances.

13. Personal Safety & Risk Acknowledgement

Exercise involves inherent risks. By attending classes, you acknowledge and accept these risks. You must complete the Pre-Screening Waiver and inform the class instructor if there are any risks to your health by participating in On Cue classes.

On Cue instructors are not medically trained and cannot assess your fitness for exercise. You are responsible for monitoring your own condition.

To the extent permitted by law, liability for recreational services is excluded under section 139A of the Competition and Consumer Act 2010 (Cth), except where injury is caused by reckless conduct by On Cue.  

You acknowledge that our instructors may use tactile curing and adjustment methods or make physical contact with you for correction purposes in order to ensure that Pilates practice is undertaken in accordance with On Cue Studio best practice.

14. Pregnancy

Standard classes (excluding heated classes) may be attended up to 14 weeks of pregnancy.

Specialty prenatal classes may be offered and are suitable throughout pregnancy, subject to medical clearance and personal comfort.

15. Personal Belongings

On Cue is not responsible for loss or damage to personal belongings. Valuables should not be brought into the studio and should be stored securely if necessary.

16. Misuse of class packs

On Cue reserves the right, at our discretion, to suspend or terminate your use of any studio Pilates class packs or memberships if we suspect any fraud or misuse of our booking system.

17. Payments

It is your responsibility to ensure there are sufficient funds available in your nominated bank account or credit card to cover the cost of purchasing any class packs or other products from us.

If a payment is declined for any reason, we reserve the right to process payment anytime where sufficient funds are available in the nominated bank account or credit card in order to settle any fees that are owed to On Cue. If an auto-debit is declined due to insufficient funds, our payment provider will charge for any failed transactions. This fee will be passed on to you approximately 7 days after the failed payment has occurred.  

On Cue is in no way, responsible for additional fees that you may incur from your bank in relation to processing payment of fees.

18. Privacy

Personal information is handled in accordance with our Privacy Policy, available on our website.

19. Photography and videography

On Cue may take photographs or videos during classes for marketing and promotional purposes. By attending a class, you consent to the use of your image in such materials.

If you do not wish to be photographed or recorded, please inform a staff member or instructor prior to the commencement of the class.

20. Limitation of Liability

To the maximum extent permitted by law, On Cue excludes all liability for any loss, damage, or injury arising from attendance at the studio or participation in classes. 

This limitation of liability applies even if On Cue has been expressly advised of potential loss.

21. Introductory Offer

The introductory offer provides unlimited classes for $50 over 14 consecutive days and is strictly limited to first-time clients. No extensions or refunds apply.                                                                                                           

22. Merchandise, accessory and clothing refunds

On Cue has the right refuse returns for change of mind. If a product purchased from On Cue is damaged or faulty, you can replace the item or be refunded the purchase price within a reasonable timeframe.

  • Student or concession identification (where applicable)

We only collect information that is reasonably necessary for the operation of our studio and the provision of our services.

  • Create an account with us

  • Purchase a membership, class pack, or gift voucher

  • Book or attend classes

  • Complete forms or questionnaires (including health declarations)

  • Communicate with us via email, phone, website, or social media

  • Use third-party booking platforms or payment providers (such as Momence)

 

4. Use of Personal Information

We use your personal information to:

  • Provide and manage our services

  • Process bookings, payments, and memberships

  • Communicate with you about classes, changes, or studio updates

You are not required to provide sensitive information; however, failure to do so may limit your ability to safely participate in classes.

7. Photography and Videography

On Cue may occasionally take photographs or videos during classes for marketing, promotional, or social media purposes.

 By attending classes at On Cue, you consent to being photographed or recorded and to the use of such images or recordings for marketing purposes, including on our website, social media platforms, and promotional materials.

If you do not wish to be photographed or recorded, please inform a staff member or instructor prior to the commencement of the class, and we will take reasonable steps to ensure you are not included.

 

8. Marketing Communications

We may send you marketing communications about On Cue, including promotions, events, or offers.

You may opt out of marketing communications at any time by following the unsubscribe instructions or contacting us directly.

 

9. Storage and Security of Personal Information

We take reasonable steps to protect your personal information from misuse, loss, unauthorised access, modification, or disclosure.

Personal information is stored securely in electronic systems and, where applicable, physical records with restricted access.

We retain personal information only for as long as necessary to fulfil the purposes outlined in this Policy or as required by law.
